《贵州省新建住宅区供配电设施建设维护管理办法》已经2013年12月18日省人民政府第19次常务会议通过,现予公布,自2014年3月1日起施行。

The Administrative Measures of Guizhou Province for Establishment and Maintenance of Power Supply and Distribution Facilities in Newly-built Residential Areas, as adopted at the 19th Standing Committee of the Provincial People’s Government on December 18, 2013, is hereby issued and shall take effect on March 1, 2014.

贵州省新建住宅区供配电设施建设维护管理办法

Administrative Measures of Guizhou Province for Establishment and Maintenance of Power Supply and Distribution Facilities in Newly-built Residential Areas

第一条为了规范新建住宅区供配电设施的建设、管理、维修和养护,确保电网的安全可靠运行,满足住户正常用电需求,根据《电力供应与使用条例》、《电力监管条例》、《物业管理条例》等法律、法规的规定,结合本省实际,制定本办法。

Article 1 These Measures are formulated under the Regulations on Supply and Use of Electric Power, Regulations on Electric Power Supervision, Regulations on Realty Management and relevant laws and regulations and in light of specific conditions of Guizhou Province for the purpose of regulating the establishment, management, repair and maintenance of power supply and distribution facilities in newly-built residential areas, ensuring safe and reliable operation of power grid, and satisfying the needs of residents for normal power use.

第二条本办法适用于本省城乡规划区内新建住宅区供配电设施的建设、管理、维修和养护。但城乡居民自建房内的用户、住宅区内使用10千伏以上电压等级供电的用户所需的供配电设施除外。

Article 2 These Measures shall apply to the establishment, management, repair and maintenance of power supply and distribution facilities in newly-built residential areas within the urban and rural planning areas of Guizhou Province, with the exception of power supply and distribution facilities required by users in self-built houses of urban and rural residents and users using more than 10 kilo-volt for power supply within the residential areas.

第三条本办法所称新建住宅,包括新建的商品住房、保障性住房以及住宅区内与住房共用供配电设施的公共设施用房和经营性用房。

Article 3 For the purpose of these Measures, newly-built residence includes newly-built commercial housing, low-income housing, and housing for public utilities and housing for business purposes sharing power supply and distribution facilities with residential housing within the residential areas.

第四条本办法所称供配电设施,是指从上级公共电源网接入点起,至新建住宅住户入户开关处,及住宅区公用配电房内公共设施和经营性用电出线处止的供配电设施(不含供配电设施用房和通道的土建部分)。

Article 4 For the purpose of these Measures, power supply and distribution facilities means power supply and distribution facilities starting from the access point of superior public power supply network and ending on household switch of newly-built residence and power outlet of public utilities in public power distribution room and business operation in residential areas (excluding civil engineering part of housing for power supply and distribution facilities and passageway).

第五条新建住宅区供配电设施应当按照城乡电网建设与改造规划,统一标准、统一建设、统一管理。

Article 5 The power supply and distribution facilities in newly-built residential areas shall be subject to unified standard, construction and management in accordance with construction and renovation plan for urban and rural power grid.

第六条新建住宅区供配电设施的设计、施工、监理、试验和运行应当符合国家标准,没有国家标准的,执行电力行业标准,国家和电力行业尚未制定标准的,执行地方标准。

Article 6 The design, construction, supervision, test, and operation of power supply and distribution facilities in newly-built residential areas shall comply with national standards, or, in the absence of national standards, standards of the power industry, or, in the absence of national standards and standards of the power industry, local standards.

第七条新建住宅区供配电设施应当与建设项目同步设计、同步施工、同步投入使用。

Article 7 The power supply and distribution facilities in newly-built residential areas shall be simultaneously designed, constructed and put into use with construction project.

第八条新建住宅区供配电设施由开发建设单位委托具备相应资质的设计单位进行设计,供电企业根据国家、省有关规定负责审核。

Article 8 The power supply and distribution facilities in newly-built residential areas shall be entrusted for design by development and construction entities to design entities with corresponding qualifications, and examined and approved by power supply enterprises subject to relevant national and provincial regulations.

第九条供电企业负责组织新建住宅区供配电设施的建设,承担建设过程中的质量、安全责任,接受相关行政主管部门的监管。

Article 9 Power supply enterprises shall be in charge of organizing the construction of power supply and distribution facilities in newly-built residential areas and assume the responsibility for quality and safety during the construction, and accept supervision from relevant competent administrative authorities.

新建住宅区开发建设单位负责新建住宅区公用配电房内公共设施和经营性用电出线点后的电气配套设施的建设。

The development and construction entities in newly-built residential areas shall be responsible for the construction of electrical supporting facilities after power outlet in public utilities in public power distribution room and business operation in newly-built residential areas.

第十条新建住宅区供配电设施建成后,供电企业负责管理、维修和养护,实行供电到户、管理到户、抄表到户、收费到户。

Article 10 Subsequent to the construction of power supply and distribution facilities in newly-built residential areas, power supply enterprises shall be responsible for the management, repair and maintenance subject to the principle of household power supply, household management, household meter reading and household fee collection.

第十一条发展改革、能源、住房城乡建设、能源监管、审计、监察、质监等部门按照各自职责,做好新建住宅区供配电设施建设、管理、维修和养护的监督管理工作。

Article 11 The departments of development and reform, energy, housing, urban and rural construction, energy supervision, audit, supervision, quality supervision, subject to their respective duties and responsibilities, do well the supervision and administration work in the construction, management, repair and maintenance of the power supply and distribution facilities in newly-built residential areas.

第十二条新建住宅区开发建设单位应当向供电企业提交用电申请,并按照要求提供制定供电方案所需的建设规划设计图纸和文件资料。

Article 12 The development and construction entities in newly-built residential areas shall submit a power use application to power supply enterprises, and provide design drawings and documents required for formulation of power supply plans.

供电企业提供供电方案的期限应当符合能源监管部门的要求,自受理用电申请之日起,高压单电源供电用户不超过20个工作日,高压双电源供电用户不超过45个工作日。

Power supply enterprises shall provide power supply plans in compliance with the requirements of energy supervisory authorities, i.e., no more than 20 business days for users of high-tension single supply, and no more than 40 business days for users of high-tension double supply, from the day when the application was accepted.

第十三条新建住宅区供配电设施施工设计图审核合格后,供电企业与新建住宅区开发建设单位签订供配电设施建设工程建设协议,协议中应当约定配置容量、材料和设备的选型、供配电设施建设费用、工程质量及完成时限等。

Article 13 After the examination and approval of the construction design drawings for power supply and distribution facilities in newly-built residential areas, power supply enterprises shall enter into engineering construction agreement for the construction of power supply and distribution facilities, providing for configuration capacity, model selection of materials and equipment, construction costs of supply and distribution facilities, engineering quality and time limit, etc.

第十四条新建住宅区开发建设单位配合供电企业办理供配电设施路由通道、建设开工等所需手续,并按照约定期限提供供配电设施用房、用地和通道。

Article 14 The development and construction entities in newly-built residential areas shall cooperate with power supply enterprises to go through formalities required for router tunnels and commencement of construction of power supply and distribution facilities, and provide housing, land and passageway for power supply and distribution facilities subject to the time limit as agreed.

第十五条开发建设单位应当按照《建设工程规划许可证》所核定的建筑面积,根据建设协议约定,按照新建住宅区开发进度,分期分批向供电企业支付供配电设施建设费用。

Article 15 The development and construction entities shall subject to the area of structure authorized by the Permit for Planning of Construction Project and the provisions of the construction agreement, pay the power supply enterprises in installments the construction costs for power supply and distribution facilities in accordance with the development progress of newly-built residential areas.

需要提供临时供电、高可靠性供电的项目,按照有关规定执行。

For those projects in need of temporary power supply and highly reliable power supply, relevant provisions shall be observed.

第十六条供配电设施建设费用用于供配电设施的材料和设备的购置、施工、监理、调试、竣工验收、维护等。

Article 16 The construction costs for power supply and distribution facilities shall be used for the purchase of materials and equipment for the power supply and distribution facilities, their construction, supervision, commissioning, acceptance of completed project, maintenance, etc.

第十七条新建住宅区供配电设施建设费用由省级价格主管部门商有关部门按照相关规定制定费用标准,并根据物价水平变化和费用使用情况适时进行调整。

Article 17 The construction costs for power supply and distribution facilities in newly-built residential areas shall be subject to expense standards formulated by competent price department at provincial level and relevant departments in accordance with relevant regulations and be timely adjusted subject to change of price level and use of the costs.

第十八条供电企业在收取供配电设施建设费用后,不得再向新建住宅区开发建设单位、购房者收取其他费用。

Article 18 The power supply enterprise, after charging the construction costs for power supply and distribution facilities, may not charge other fees from development and construction entities and home purchasers in newly-built residential areas.

第十九条新建住宅区项目投入使用后,新建住宅区开发建设单位根据住房城乡建设行政主管部门最终核准的建筑面积,与供电企业按照省级价格主管部门制定的费用标准结清供配电设施建设费用。

Article 19 After the project of newly-built residential areas is put into use, the development and construction entities in newly-built residential areas shall, subject to the area of structure finally approved by competent administrative department of housing and urban and rural construction, settle the construction costs for power supply and distribution facilities with power supply enterprises in accordance with the expense standards formulated by competent price department at provincial level.

第二十条价格主管部门对供配电设施建设费用支付和使用情况实施监督管理。

Article 20 The competent department of price shall supervise and administer the payment and use of the construction costs for power supply and distribution facilities.

新建住宅区供配电设施建设费用实行专户存储、专款专用,供电企业应当建立完善财务管理办法,规范费用管理,每半年至少向社会公开一次上半年度费用收支情况,接受社会监督。

The construction costs for power supply and distribution facilities in newly-built residential areas shall be deposited in special account and used for specific purposes. The power supply enterprise shall formulate and improve measures for financial management to regulate expense management, and release to the public the receipts and disbursements of the previous half year at least once half a year to accept social supervision.

第二十一条新建住宅区供配电设施建设,应当在发展改革、能源、能源监管部门的指导、监督下,依法通过公开招标投标,择优选择具有相应资质的施工、监理单位及设备材料供应商。

Article 21 The construction of power supply and distribution facilities in newly-built residential areas shall select on merit construction and supervision entities and suppliers for equipment and materials under the guidance and supervision of such department of development and reform, energy, energy supervision, and through open bidding and tendering in accordance with the law.

第二十二条新建住宅区供配电设施工程竣工后,由开发建设单位和供电企业共同组织设计、施工、监理单位进行验收。经验收合格,并按照国家规定检验合格后,方可投入使用。

Article 22 Upon the completion of power supply and distribution facilities in newly-built residential areas, the development and construction entities and power supply enterprise shall jointly organize acceptance inspection by the design, construction and supervision entities. The project will be put into use upon acceptance inspection and passing inspection in accordance with state regulations.

第二十三条新建住宅区供配电设施工程验收和检验合格后,施工单位向供电企业移交工程档案资料一式两份,一份由供电企业留存,另一份转交开发建设单位。开发建设单位在检验合格后10个工作日内,将检验合格报告等资料报工程所在地的县级以上住房城乡建设行政主管部门备案。

Article 23 Upon the acceptance check and inspection of the power supply and distribution facilities in newly-built residential areas, the construction entity shall transfer the engineering files and materials to the power supply enterprise in two copies, with one copy retained by the power supply enterprise, and another transferred to the development and construction entities. The development and construction entities shall, within 10 working days after passing the inspection, submit the inspection report and other materials to competent administrative department of housing and urban and rural construction above the county level at the place where the engineering is located for record.

第二十四条按照本办法建设的供配电设施,由供电企业负责供配电设施的管理、维修、养护、更新及相关费用。

Article 24 Power supply enterprises shall be responsible for the management, repair, maintenance, updating and related costs of the power supply and distribution facilities constructed the accordance with these Measures.

第二十五条供电企业应当建立健全供配电设施的运行维护和管理制度,严格执行供配电设施运行维护的有关技术标准规范和操作规程,保障供配电设施的完好和运行正常。

Article 25 Power supply enterprises shall establish and improve system for operating maintenance and management of power supply and distribution facilities and strictly implement relevant technical standards and specifications as well as operational procedures for the operation and maintenance of power supply and distribution facilities to ensure that the power supply and distribution facilities are in good condition and proper operation.

第二十六条供电企业应当确保24小时受理供配电设施故障报修业务。供配电设施出现故障时,应当按照能源监管部门规定时限处理,保证用户正常用电。

Article 26 Power supply enterprises shall ensure that they are available 24 hours to accept any request for repair of any breakdown in the power supply and distribution facilities. Any breakdown occurred to the power supply and distribution facilities shall be dealt with within the time limit prescribed by energy regulatory authorities to ensure normal power use by the users.

供电企业应当建立用电投诉处理制度,公开投诉电话。对用户的投诉,供电企业应当自接到投诉之日起10个工作日内提出处理意见并答复用户。

A power supply enterprise shall establish a system for handling complaints with regard to power use, and announce its complaint hotline. With regard to any user's complaint, a power supply enterprise shall provide its opinion and make reply to the user within 10 working days from the date of receiving the complaint.

第二十七条开发建设单位不按照规定及约定支付供配电设施建设费用,由供电企业书面告知限期支付,逾期仍不支付的,供电企业暂停办理其用电业务。

Article 27 Any development and construction entity who fails to pay the construction costs for power supply and distribution facilities in accordance with regulations or as agreed shall be notified in writing by power supply enterprise to make payment within the prescribed time limit, failing of which the power supply enterprise may suspend processing its power use business.

第二十八条供电企业违反规定,擅自或变相提高收费标准、降低电力工程建设设备和材料配置标准、不按照规定组织招标投标、不按照规定履行维修养护职责,或者有其他违反本办法行为的,由政府相关部门按照职责范围依法查处。

Article 28 Any power supply enterprise who, in violation of regulations, without authorization or in any disguised form increase charging standard, reduce configuration standard for equipment and materials for power engineering construction, fails to organize bidding and tendering in accordance with relevant regulations, fails to perform the duties of repair and maintenance in accordance with relevant regulations, or engages in any other act in violation hereof shall be lawfully investigated and dealt with by relevant government authorities subject to their scope of official duties.

第二十九条供电企业逾期未完成供配电设施工程,给新建住宅区开发建设单位造成损失的,按照建设协议的约定承担相应责任。

Article 29 Any power supply enterprise who fails to complete the project of power supply and distribution facilities, thus causing losses to the development and construction entity of the newly-built residential area shall assume corresponding liability subject to the provisions of the construction agreement.

第三十条供电企业工作人员滥用职权、玩忽职守、徇私舞弊,损害开发建设单位及购房人或用户合法权益的,依法追究相应责任。

Article 30 Any staff member of an power supply enterprise who abuses his power, neglects his duties, practices favoritism and engages in malpractice, thus damaging the legitimate rights and rights of any development and construction entity and real estate purchaser or user, shall be held liable for relevant liability in accordance with the law.

第三十一条本办法实施前供电企业已受理用电申请但未提供供电方案的,按照本办法执行。

Article 31 Any power supply plan not yet provided by the power supply enterprise after acceptance of power use application prior to the implementation of these Measures shall be conducted in accordance with these Measures.

本办法实施前供电企业受理用电申请并已提供供电方案的,可由开发建设单位与供电企业参照本办法协商处理。

Any power supply plan provided by the power supply enterprise after acceptance of power use application prior to the implementation of these Measures shall be settled by the development and construction entity and power supply enterprise through negotiation with reference to these Measures.

第三十二条本办法自2014年3月1日起施行。

Article 32 These Measures shall take effect on March 1, 2014.
